1. Data controller

This Privacy Policy sets out how Raqt Sweden AB, Reg. No 559137-8707, (“Raqt”, “we”, “our” or “us”) a company incorporated and organised under the laws of Sweden, with its registered address at Våtmarksvägen 14, 186 55 Vallentuna, Sweden, is the data controller in accordance with the European data protection laws (the “GDPR”). Raqt collects, uses and shares information that we obtain as a result of your use of the Raqt mobile application (or “app”), our website at http://www.raqt.com, or other applications and tools, and any related services (collectively the "Services"). By using or accessing the Services, you confirm that you have received this Privacy Policy and that you agree to the use of your information as explained in this Privacy Policy. If you do not agree, please do not use the Services.

2. Personal Data

Raqt's website and mobile applications are services for logging, tracking, and sharing information related to Pickleball and other related racket sports. To provide these services we may collect, process and store information about you. The type of personal information we may collect and process includes your name, username, password, email address, telephone number, address, gender, location data, payment information (from Stripe, Google and Apple), as well as any other user generated content that may be personally identifiable such as photos and videos. When you use our application, we also collect information such as content that you browsed and the date and duration of your use.

Your privacy is important to us. Any data collected and/or stored by us is used to provide the Services and improve our Services, develop new products and services, conduct statistical analysis, provide information to research partners, create rankings, analyze your use and personalize the Services. We may also use your information for marketing purposes for which we will ask consent from you.

3. Purpose for which your personal data is processed

Our purpose of the processing of your personal data is to manage our relationship with you in accordance with our agreements, for each service you choose to use. This includes creating and sending information to you in electronic format (not marketing). To be able to perform customer satisfaction surveys and market surveys as well as ask for reviews from you, through email, text messages, phone or via other communication channels. To be able to provide extra help to you as a customer (i.e. if you need extra support when contacting us due to particular circumstances). This means that we can offer you special support, for example, when you contact customer support. We need to handle your personal data to deliver to you the Services embedded in the application; this enables you to manage a variety of competition activities, to log results, set up and create rankings, arrange private or public competitions, and interact with other players. We may need your personal data to manage financial transactions related to the Services for example application fees for tournaments that we sponsor. Any personal data collected from you may only be transferred outside the European Union/the European Economic Area by observing applicable privacy regulations (GDPR) and ensuring your privacy rights are protected. In addition to the things mentioned in this policy, we also share your information with service providers to perform functions and process user data and help provide our Services, consistent with this Privacy Policy. For instance, we work with Amazon Web Services to host and process our data and we may work with various analytics providers to help us understand the use of our Services to build a better product. Where a third-party processes user data on our behalf, it is subject to the security and confidentiality obligations consistent with this Privacy Policy and applicable law. When you submit information as part of a competition or interact with us on social media, we may publish the information you submitted with your name in our app and social media channels.

4. Sharing personal data

Raqt shares your personal data with some of our suppliers and subcontractors. Suppliers and subcontractors are companies that only have the right to process the personal data they receive from Raqt on behalf of Raqt, i.e. data processors. Examples of such suppliers and subcontractors are software and data storage providers, payment service providers and business consultants. We need access to services and functionality from other companies where we cannot perform them ourselves. Raqt has a legitimate interest in being able to access these services and functionality. The third party processing that this entails is necessary to pursue our legitimate interest, an interest that outweighs your right not to have your information processed for this purpose. You are entitled to object to this processing, for reasons connected to the circumstances in your particular case.

5. Your rights

You have certain rights in relation to the personal information that we hold about you. Those rights include:

• Right of access: You have a right to know what information we hold about you and to have the information communicated to you. In case you want to exercise this right, please contact us and let us know what information you would like to receive. We may need to verify your identity before we provide you with any information. Note that we may not be able to provide all the information you ask for, especially if the information includes personal information about another person.
• Data Portability: You have the right to receive your personal data in machine-readable format.
• Data rectification/deletion: You have a right to have the personal information that we hold about you rectified or deleted. Should you wish to have any information about you rectified or deleted, please contact us at support@raqt.com. Where we delete personal information about you, we may still retain some or all of that information for other purposes such as maintaining financial records, protecting or enforcing legal rights, or for technical reasons such as maintaining our database integrity. We may also retain your information in an anonymized form.
• Account deactivation: If you have an account with us and object to our processing of your personal data or you want us to deactivate your account, you can ask us to deactivate it by contacting us at support@raqt.com. We may ask you for other information before we are able to deactivate your account.
• Withdrawal of consent: If you have selected to receive direct marketing communications from us, and you want to stop receiving it, you can click on the opt-out link in the marketing communication sent.

6. Security

We will use commercially reasonable efforts to safeguard the confidentiality of your personal information. However, we cannot be held liable for any loss of or disclosure of data or any losses or damages incurred due to errors in transmission or unauthorized or unlawful acts of third parties or your decision to disclose your personal information.

7. Cookies

By using the Services you agree to our use of cookies on the Services. Cookies are small text files that websites send to your computer to uniquely identify your browser or to store information or settings in your browser. You can choose not to store cookies by turning acceptance of cookies off in the settings of your web browser used to access the Services. You can also delete cookies. Please note, however, that without cookies you may not be able to use all of the features of the Services.

8. Storage of personal data

We store your data, including your name, username, password, email address, telephone number, address, and gender, and the content created by you such as posts, photos, and videos, as long as it is necessary for the provision of our services to you. How long Raqt stores your personal data depends on the purposes for which Raqt uses the personal data:

• Personal data used for the contractual relationship between you and Raqt is generally stored for the duration of the contractual relationship and thereafter for a maximum of 10 years based on statutes of limitations.
• Personal data that Raqt may be under a legal obligation to retain, for example under anti-money laundering laws or bookkeeping laws, is generally retained for 5 and 7 years respectively.
• Personal data which is not used for the purposes of your contractual relationship with us or where we do not have a legal obligation to retain the data is only retained as long as necessary to fulfill the respective purpose for our data processing (usually 3 months). Please note that just because we have a legal obligation to store your personal data, this does not mean that we are also permitted to use this data for any other purpose. Raqt will make an assessment for each specific purpose of how long we may use your personal data.

10. Terms of Service

If you choose to use the Services, your use of the Services, including access to www.raqt.com and our app(s), and any dispute over privacy is subject to this Privacy Policy and our Terms of Service - https://www.raqt.com/terms-of-service, including limitations on damages, resolution of disputes, and application of the law of the Country of Sweden.

11. Revisions

We may change this Privacy Policy at any time without notice, effective upon posting or as otherwise required by applicable law. When we do make modifications to this Privacy Policy we will revise the date at the top of the Privacy Policy posted on our website and app. If you do not wish to accept such modified Privacy Policy, you can terminate your account. Any continued use by you of the Services following the posting of modified Privacy Policy shall constitute your acceptance of such policy. We may email periodic reminders of our notices and conditions, but you should check www.raqt.com or the app frequently to see recent changes. We may also provide you with additional notice (such as adding a statement to our website’s homepage or providing you with an in-app notification). The Raqt Terms of Service may be modified from time to time as provided therein. We stand behind the promises we make and will never materially change our Privacy Policy or practices to make them less protective of customer information collected in the past without the consent of affected customers.
